Request for Proposal for Strengthening the Judicial Commission's Recommendations to the Supreme Court

DT Global supports the implementation of the Australia Indonesia Partnership for Justice Phase 3 (AIPJ3). AIPJ3 is a five-year program funded by the Australian Department of Foreign Affairs and Trade (DFAT) to work in partnership with the Government of Indonesia (GOI) to support advancement of its priority law and justice reforms and contribute to the overall goal of “Strong and accessible justice and security institutions uphold the rule of law and contribute to stability and prosperity in Indonesia and the region”.

 AIPJ3 has the following end-of-program outcomes (EOPOs):

  • EOPO 1: Justice institutions develop and implement policies, plans, budgets and practices that advance the rule of law and economic development in the priority areas of accountability and transparency, criminal and commercial law reform
  • EOPO 2: Justice institutions and partners implement and adapt policies, plans, budgets and practices that contribute to preventing violent extremism and addressing transnational crime
  • EOPO 3: Justice institutions develop and implement policies, plans, budgets and practices that advance equal access to justice for women, children and persons with disabilities
  • EOPO 4: Government of Indonesia, Government of Australia and non-government organisations deepen partnerships in the justice and security sectors for mutual benefit.

Under the Access to Justice Strategy (EOPO 3), AIPJ3 is seeking a qualified Subcontractor to support the Ministry of National Development Planning (Bappenas) in conducting an analytical study and developing evidence-based policy recommendations to strengthen the effectiveness of the Judicial Commission’s oversight function and its recommendations to the Supreme Court. The assignment will contribute to judicial reform and institutional strengthening in Indonesia’s justice sector, in alignment with the priorities of the National Medium-Term Development Plan (RPJMN) 2025–2029.

About the Engagement

The study is intended to generate evidence-based policy recommendations to strengthen the effectiveness of the Judicial Commissionʼs oversight function and its recommendations to the Supreme Court. Through this process, the activity aims to contribute to ongoing judicial reform efforts and support institutional strengthening initiatives within Indonesiaʼs justice sector. The objectives of the service are as follows:

  1. To analyse the fundamental factors undermining the Supreme Courtʼs (MA) follow-up on Judicial Commission (KY) recommendations regarding violations of the Code of Ethics and Conduct for Judges (KEPPH), including legal, procedural, and inter-institutional constraints.
  2. To analyse the institutional and substantive aspects that prevent Judicial Commission recommendations from being acted upon, and to formulate structural, regulatory, and institutional measures to strengthen the Commission in issuing recommendations for judicial oversight.
  3. To formulate policy options for strengthening both the substance of Judicial Commission recommendations and its institutional capacity, enabling the Commission to execute its oversight mandate more effectively and credibly, in alignment with the 2025–2029 National Medium-Term Development Plan (RPJMN).
  4. To produce evidence-based policy recommendations and a final study report on "Strengthening Judicial Commission Recommendations to the Supreme Court," which will serve as a reference for Bappenas, the Judicial Commission, and the Supreme Court in realising a more accountable, transparent, and independent judiciary.
