Program Background

Australia-Indonesia Partnership for Justice Phase 3 (AIPJ3) is a five-year investment by the Australian Department of Foreign Affairs and Trade (DFAT) to partner with the Government of Indonesia (GOI) to advance its priority law and justice reforms. It aligns with Indonesia’s National Development Plans (Long- Term National Development Plan 2025-2045, Mid-Term National Development Plan 2025-2029) and the Australia-Indonesia Development Partnership Plan 2024-2028.

Building on previous phases, AIPJ3 will support partners to deliver activities against agreed policy priorities, while maintaining the flexibility to respond to emerging needs and opportunities. The program focuses on seven policy priorities that are important to Australia and Indonesia: accountability and transparency, criminal justice reform, preventing violent extremism, transnational crime cooperation, commercial law, access to justice, and women’s leadership.

AIPJ3 will progress the long-term goal of “Strong and accessible justice and security institutions that uphold the rule of law and contribute to stability and prosperity in Indonesia and the region”. With the specific objective of “working in partnership with Indonesia to support effective realisation of justice reforms”, AIPJ3 has the following end-of-program outcomes (EOPOs):

• EOPO 1: Justice institutions develop and implement policies, plans, budgets and practices that advance the rule of law and economic development in the priority areas of accountability and transparency, criminal and commercial law reform
• EOPO 2: Justice institutions and partners implement and adapt policies, plans, budgets and practices that contribute to preventing violent extremism and addressing transnational crime
• EOPO 3: Justice institutions develop and implement policies, plans, budgets and practices that advance equal access to justice for women, children and persons with disabilities
• EOPO 4: Government of Indonesia, Government of Australia and non-government organisations deepen partnerships in the justice and security sectors for mutual benefit

The protection and promotion of human rights constitute an important component of Indonesia's national development agenda and are reflected in the Government's continued efforts to strengthen democratic governance, the rule of law, and access to justice. Within this broader framework, independent National Human Rights Institutions (NHRIs) play a strategic role in safeguarding human rights, promoting accountability, and ensuring that vulnerable groups have access to effective protection mechanisms.

Komisi Nasional Anti Kekerasan terhadap Perempuan (Komnas Perempuan) serves as one of Indonesia's principal independent institutions mandated to advance and protect women's human rights. Over time, its responsibilities have expanded in response to evolving legal and policy frameworks, particularly following the enactment of Law No. 12 of 2022 on Sexual Violence Crimes (Undang-Undang Tindak Pidana Kekerasan Seksual/UU TPKS), which assigns additional responsibilities to the institution in supporting the implementation of protection and recovery mechanisms for victims of sexual violence.

While the expansion of Komnas Perempuan's mandate reflects increasing recognition of its strategic role, it also presents institutional challenges that require careful assessment. The institution's legal basis, governance arrangements, organisational structure, budget management, and human resource capacity have evolved incrementally and may no longer fully correspond to the scope and complexity of its current functions. Questions regarding institutional independence, organisational effectiveness, adequacy of staffing, remuneration systems, and budget governance have become increasingly relevant as the institution assumes broader responsibilities.

At the same time, strengthening institutional capacity requires a comprehensive understanding of Komnas Perempuan's current position within Indonesia's broader human rights architecture. This includes examining its relationship with the executive branch, assessing existing governance arrangements, clarifying the scope of its statutory authority, and identifying institutional arrangements necessary to ensure effective implementation of its expanded mandate under UU TPKS.

Accordingly, a comprehensive study is required to assess the institutional, legal, and governance arrangements of Komnas Perempuan and identify opportunities for institutional strengthening. The study is expected to generate practical policy recommendations on regulatory reform, organisational development, budget governance, and human resource management to support Komnas Perempuan's role as an independent, effective, and sustainable National Human Rights Institution arrangements, and formulate evidence-based policy recommendations on the revitalization of corruption prevention in priority sectors. The study is expected to provide practical recommendations that will support future policy development and institutional strengthening initiatives undertaken by the Ministry of National Development Planning/Bappenas and relevant Ministries and Government Institutions.

 About the Engagement:

 AIPJ3 is seeking a qualified Subcontractor to support Ministry of National Development Planning (Bappenas) to conduct a comprehensive study to assess the institutional, legal, and governance arrangements of Komnas Perempuan and identify opportunities for institutional strengthening. The study is expected to generate practical policy recommendations on regulatory reform, organisational development, budget governance, and human resource management to support Komnas Perempuan's role as an independent, effective, and sustainable National Human Rights Institution. Specifically, the selected organisation is expected to:

1. Identify and analyse key problems, strategic issues, and institutional challenges affecting the development of laws, regulations, and governance related to corruption prevention and public services.
2. Map strategic issues and policy directions concerning the revitalization of corruption prevention in priority sectors.
3. Conduct comprehensive literature reviews and analyse relevant studies, research findings, regulations, and policy documents related to corruption prevention and governance reform.
4. Undertake stakeholder consultations through Focus Group Discussions (FGDs) and other appropriate consultation mechanisms involving relevant stakeholders in the legal, governance, and regulatory sectors.
5. Develop evidence-based policy recommendations to support the revitalization of corruption prevention in priority sectors and strengthen future policy development
